How does a court order someone into treatment in Las Vegas?

A court orders someone into treatment in Las Vegas mostly through a criminal case, by way of sentencing, probation, a specialty court or pretrial diversion. The Eighth Judicial District Court runs an Adult Drug Court, an 18-month court-supervised program that combines inpatient and outpatient care.

The same court also runs a Transitional Age Drug Court Program for ages 18 to 26, a Co-Occurring Disorders Court and a MAT Re-Entry Court. The specialty court office can be reached at 702-671-5220. Is there a civil route?

Nevada’s civil route for substance use is narrow. Under NRS 458.270, police place a person who is intoxicated in public and unable to stay safe in civil protective custody. That custody allows no forced stay in a licensed facility beyond 48 hours. Nevada’s treatment chapter does not appear to set out a separate court commitment process for substance use.

Will a Las Vegas court accept any licensed treatment program?

Acceptance is not automatic, because the judge or supervising officer decides which programs meet the order. Nevada’s Division of Public and Behavioral Health certifies treatment programs. A program without that certification cannot receive state or federal funding.
