Court Ordered Rehab Centers in South Dakota

Court ordered rehab in South Dakota usually starts with a judge, a probation officer or a treatment court team setting out what treatment has to happen and how progress gets reported. The listings on this page show programs in the state that say they accept clients with a court order, with their levels of care, payment options and services.

Half of these programs sit in towns and half in rural areas, and Rapid City and Sioux Falls hold the largest clusters. Details come from government treatment registers, state licensing records, accreditor listings and information the providers send us. Whether a court accepts a given program is for the court to decide.

Common questions about Court Ordered Rehab

Answered from what is listed here.

Where are court ordered rehabs in South Dakota?

Listings for court ordered rehab in South Dakota cluster in Rapid City, followed by Sioux Falls, Huron, Hot Springs and Flandreau. Rapid City, Sioux Falls and Huron are the big cities among those five places.

A program close to home can make regular sessions easier to reach. Court requirements apply wherever treatment takes place, so checking a program with the court or probation officer first is sensible.

Rehab Centers in Rapid Cityhttps://rehabseekers.com/locations/us/south-dakota/rapid-city/
Is court ordered rehab covered by South Dakota Medicaid?

South Dakota Medicaid pays providers on a fee-for-service basis with no managed care plans, and nearly all of the court ordered rehab programs in South Dakota record accepting it. The state uses a primary care case management model with a monthly case management fee, including for the expansion adult group.

Rehab Centers in South Dakota That Accept South Dakota Medicaidhttps://rehabseekers.com/locations/us/south-dakota/south-dakota-medicaid/
Are there court ordered rehabs near a river in South Dakota?

About half of the court ordered rehab programs in South Dakota sit within 25 miles of a river, and the nearest one is a median of about 19.4 miles from listed facilities.

The East Fork Vermillion River, the Iron River and the Fall River are the rivers named most frequently near these listings. River proximity concerns surroundings only; court conditions, level of care and payment route usually decide where treatment happens.

How does a court order someone into treatment in South Dakota?

A South Dakota court can require treatment through criminal sentencing, probation conditions, pretrial diversion or a treatment court. Terms differ by court and by case, so ask the defense attorney what applies. Most orders begin with an assessment, and the level of care that assessment recommends then becomes part of the requirement.

For people on probation or parole, the Department of Social Services, the Department of Corrections and the Unified Judicial System offer Cognitive Behavioral Interventions and Moral Reconation Therapy, in person or by telehealth. The Division of Treatment Courts runs Drug Court, DUI Court, Veterans Court and Mental Health Court.

First-offense DUI cases with a blood alcohol level of 0.17 or more carry a mandatory court-ordered assessment for substance dependency under South Dakota Codified Laws 32-23-2.1. A credentialed addiction professional or licensed health professional does the assessment, and the defendant pays for it.

DUI classes come from agencies on the Division of Behavioral Health’s DUI agency list, grouped by judicial circuit. See DUI and DWI programs in South Dakota. Before intake, check with the probation officer or coordinator that a program will satisfy the order, and know that the court sees progress reports only once you have signed a consent form naming who may receive them.

Civil commitment is a separate route

Involuntary commitment for alcohol or drug use is a civil matter in South Dakota, set out in SDCL 34-20A-70 to 34-20A-70.3. A spouse, guardian, relative, physician, facility administrator or other responsible person can petition a circuit court. Grounds include harm to self or others, incapacity from intoxication, or pregnancy with substance use.

Will a South Dakota court accept any licensed treatment program?

A South Dakota court usually expects a state-accredited program, and the judge or supervising officer has the final word. The Office of Licensing and Accreditation in the Department of Social Services accredits substance use disorder providers under ARSD Article 67:61. Ask the probation officer or treatment court coordinator about a program before intake. RehabSeekers.com cannot say whether a court will accept it. Listings show accreditation, languages and populations served where providers report them. That helps if an order names a track such as veterans rehab in South Dakota.

Progress reports reach the court only after you sign a written consent. Federal confidentiality rules at 42 CFR Part 2 protect substance use treatment records. The release has to name who receives information, such as the judge, probation office or treatment court team, and what may be shared. Ask the admissions team whether staff send attendance and progress reports, and how often.

What levels of care can a South Dakota court require?

A South Dakota order usually calls for an assessment first, then the level of care that assessment recommends. Some orders also set a minimum length or number of sessions.

Level of careWhat it usually means for a court order
DetoxSupervised withdrawal before further care. Withdrawal from alcohol, benzodiazepines or opioids can be medically serious.
ResidentialLive-in treatment, often when the assessment finds high need.
Partial hospitalization (PHP)Day treatment most weekdays, home at night.
Intensive outpatient (IOP)Several sessions a week around work or family.
OutpatientRegular counseling, often a step down or DUI follow-up.

No South Dakota treatment court rule on medication for opioid use disorder appears in the sources behind this page. Ask the coordinator before starting or changing a medication. The State Opioid Response grant, run by the Department of Social Services, aims to widen access to medication-assisted treatment. Programs offering buprenorphine are listed under Suboxone clinics in South Dakota.

How do you pay for court-ordered treatment in South Dakota?

South Dakota Medicaid, run by the Department of Social Services, expanded to more adults on July 1, 2023. The program pays fee-for-service with primary care case management, so there is no managed care plan to choose. See programs that accept Medicaid. The Division of Behavioral Health also funds contract services. Its fiscal 2027 fee schedule sets low-intensity residential care at $96.49 per day and individual counseling at $31.87 per 15 minutes.

Listings show whether a program takes Medicaid, state funding, private insurance or a sliding scale. The state-funded programs in South Dakota page gathers public options. Intensive Methamphetamine Treatment is a long-term Matrix Model program for adults with moderate to severe methamphetamine use disorder. Medicaid, insurance or state and federal funds pay for it, and providers are in Sioux Falls, Mitchell, Rapid City, Rosebud and Aberdeen.

What happens if you miss sessions on a South Dakota treatment order?

Missed sessions usually reach the court or supervising officer through the reports you consented to, and the judge decides what follows. The response varies by court and by case, so tell your attorney or probation officer early if you cannot attend.

Help lines and finding a program

Programs on this page cluster around Rapid City and Sioux Falls, and 64 percent sit within 25 miles of a river, most often the East Fork Vermillion River. The nearest airport is a median of 9.5 miles away, most often Sioux Falls Regional Airport. That is worth knowing when hearings and treatment are in different towns.

For treatment information at any hour, call 988, which now reaches the South Dakota Resource Hotline run by the Helpline Center. You can also text “opioid” to 898211, or call the national treatment referral line. Read more about court-ordered treatment, or see every option on the South Dakota rehab page.
