How does a court order someone into treatment in Illinois?

In Illinois, a court order for treatment usually comes through a criminal case, as part of a sentence, a condition of probation or supervision, a pretrial or deferred arrangement, or entry into a problem-solving court. The judge sets the terms, and those terms differ by case, county and charge.

Problem-solving courts are a major route into treatment across the state. The Illinois Supreme Court certifies drug, mental health, veterans, DUI and hybrid courts, each with its own entry rules, phases and completion terms. For DUI cases, a person found guilty must complete a professional alcohol and drug evaluation before the judge sentences them.

Civil commitment is a separate path, and no Illinois commitment statute appears to be aimed solely at substance use disorders. Judges generally want a licensed provider able to carry out every term of the order, so check with your attorney or probation officer about any program list the court relies on.
