What is the 28-day rule in New York Medicaid?

The 28-day rule bars Medicaid managed care plans and fee-for-service Medicaid from requiring prior authorization for inpatient, residential or withdrawal care at in-network OASAS-licensed programs, and from concurrent review during the first 28 calendar days.

The program must still notify the plan of admission within 2 business days. It protects a stay from review rather than capping how long it can last.

Does New York Medicaid need prior authorization for outpatient or IOP treatment?

No. In-network outpatient, intensive outpatient and opioid treatment program services need no prior authorization, and no concurrent review applies for the first 4 weeks of continuous treatment, up to 28 visits.

What is LOCADTR?

LOCADTR, short for Level of Care for Alcohol and Drug Treatment Referral, is the OASAS level-of-care tool, now version 3.0, built with NYU Grossman School of Medicine to decide the right level of substance use treatment.

Every insurer regulated by New York, including Medicaid managed care plans and fee-for-service Medicaid, must use LOCADTR or an OASAS-approved alternative for these decisions.

What is a HARP plan in New York Medicaid?

A Health and Recovery Plan, or HARP, is a specialty Medicaid managed care plan for adults 21 and older with serious mental illness or a substance use disorder who meet the state's high-risk criteria.

A HARP adds Health Home care management, behavioral health home and community based services and CORE services such as peer support. Members also enrolled in Medicare cannot join.

What is NYRx?

NYRx is the New York State Medicaid pharmacy program. Since April 1, 2023 it has paid for medically necessary FDA-approved drugs, including addiction medications, for members of mainstream plans, HARPs and HIV special needs plans.

Essential Plan, Child Health Plus and managed long-term care members keep their own pharmacy benefit and should ask their plan directly.

Is the Essential Plan the same as New York Medicaid?

No. The Essential Plan is separate, $0-premium coverage for New York residents ages 19 to 64 whose income is above the Medicaid limit, bought through NY State of Health rather than issued as Medicaid.
