No criminal charge is involved. Florida minors can consent to voluntary treatment from a licensed provider at any age, but that rule does not cover involuntary admissions.

Will a Florida court accept any licensed treatment program?

Not automatically. The judge, drug court team or supervising officer decides which programs satisfy an order, and a state license is the baseline. The Florida Department of Children and Families licenses substance use providers under Chapter 397, and s. 397.401 makes it unlawful to operate without that license. Ask a program for its DCF license details in writing and pass them to your attorney or officer before you enroll. Reports to a Florida court need your written consent. Federal confidentiality rules for substance use treatment (42 CFR Part 2) bar a program from sharing attendance or progress without a signed release. The release should name the court or officer, the information to be shared and how long the consent lasts.

What levels of care can a Florida court require?

A Florida order can require an assessment first, a specific level of care, a minimum length of treatment or a combination of these. The table shows how the levels in the listings match the wording an order may use.

Medication for opioid use disorder is a separate question from level of care. In Florida, methadone programs are regulated by the State Methadone Office within the DCF Substance Abuse and Mental Health Program. Options are listed under methadone clinics in Florida. Each court or probation office decides whether it permits methadone or buprenorphine, so get that answer in writing before you start or change a medication. Florida’s telehealth law limits prescribing Schedule II drugs by video, but buprenorphine, a Schedule III drug, falls outside that limit.

How do you pay for court-ordered treatment in Florida?

Court-ordered treatment in Florida is paid for in the same ways as other care: Medicaid, state funding, sliding-scale fees, private insurance or self-pay, as each listing reports. Florida Medicaid is run by the Agency for Health Care Administration. Most members get coverage through a Statewide Medicaid Managed Care plan such as Sunshine Health, Simply Healthcare or Molina Healthcare. Florida has not adopted the adult Medicaid expansion, so adults have narrower eligibility than in expansion states. Programs that take Medicaid say so in their listings.

Public treatment funding in Florida flows through DCF, which passes federal block grant money to regional Managing Entities that contract with local providers. What happens if you miss sessions on a Florida treatment order?

The judge decides what follows missed sessions, and the response depends on the case, the court and the terms of the order. If you know you will miss a session, tell the program and your attorney or supervising officer beforehand, and keep copies of your attendance records.

Florida programs that list court-ordered clients sit mostly near the coast. In this group, 71 percent are within 25 miles of the shoreline, a median of 4.8 miles away, and 90 percent are within 30 miles of an airport. Miami International and Tampa International are among the most common nearest airports. Jacksonville, Tampa, Ocala and Gainesville come up often, while the Panhandle and the rural interior north of Orlando have fewer options.
