Court Ordered Rehab Centers in Massachusetts

Court ordered rehab in Massachusetts can begin in a criminal courtroom, in a specialty session run by the Trial Court, or through a civil petition under Section 35. Each route sets its own terms. The judge, defense attorney or probation officer on the case is the person who can say what a given order requires.

The Massachusetts programs listed here describe working with court-referred clients. The listings draw on government treatment registers, state licensing records, accreditor listings and information the providers send us. Use them to compare levels of care, payment options and reporting arrangements before you raise a choice with the court.

Common questions about Court Ordered Rehab

Answered from what is listed here.

Which Massachusetts cities have court ordered rehabs?

Massachusetts listings for court ordered rehab cluster in Roxbury Crossing, Worcester, Springfield, Fall River and Lowell. Each of these places appears often among programs that take court referrals and send attendance reports to probation officers or judges.

Boston, Worcester and Lowell are the larger cities nearby, so people living outside the main clusters often look toward them. Asking a program whether it has worked with your specific court before can save time during intake.

Rehab Centers in Roxbury Crossinghttps://rehabseekers.com/locations/us/massachusetts/roxbury-crossing/
Does MassHealth cover court ordered rehab in Massachusetts?

MassHealth coverage for court ordered rehab runs through the member's plan, and nearly all of the court ordered rehab programs in Massachusetts record accepting it. Plans include the Massachusetts Behavioral Health Partnership, Fallon 365 Care and WellSense Community Alliance; intake staff can confirm which one applies.

Rehab Centers in Massachusetts That Accept MassHealthhttps://rehabseekers.com/locations/us/massachusetts/masshealth/
Are there court ordered rehabs near a river in Massachusetts?

Within 25 miles of a river sit nearly all of the court ordered rehab programs in Massachusetts, and the median distance from listed facilities to the nearest one is about 2.2 miles. The most-named rivers are the Muddy River, the Middle River and the Westfield River.

For someone under a court order, attendance rules, reporting requirements and a program's location usually matter far more than a view of the water nearby.

How does a court order someone into treatment in Massachusetts?

A Massachusetts court can order someone into treatment in several ways: as a condition of a sentence or probation, through pretrial or specialty court supervision, or through a civil Section 35 commitment that stands apart from any criminal case.

Specialty sessions, including Recovery Courts, the newer name for drug courts, along with Veterans Treatment Courts and Mental Health Courts, are run by the Trial Court’s Specialty Courts Department. Outside those sessions, a judge may still make treatment a term of probation or of a pretrial agreement. Drunk driving cases follow their own path through state-licensed impaired driving programs.

Section 35 lets a judge send someone with an alcohol or drug use disorder to inpatient care when the person’s drinking or drug use makes serious harm likely. Holding a state license does not settle the matter, since the judge and the supervising officer decide whether a particular program meets the order.

Reports to a judge or probation officer need your written consent under federal confidentiality rules for addiction treatment records, so ask intake staff what they send and how often. Court-ordered care is paid for the same ways as voluntary care, whether by MassHealth, a private plan, a sliding fee or state-funded services.

Criminal and specialty court routes

Specialty sessions in Massachusetts are run by the Specialty Courts Department of the Executive Office of the Trial Court. Recovery Courts, the current name for what used to be called drug courts, operate alongside Veterans Treatment Courts, Mental Health Courts and family-centered specialty courts. These sessions sit within the District, Boston Municipal, Juvenile and Probate and Family Courts. Judges can also attach treatment to probation or a pretrial arrangement outside these sessions.

Drunk driving cases in Massachusetts follow their own path. A first offense resolved under the 24D disposition in M.G.L. c.90 leads to the Massachusetts Impaired Driving Program. Repeat cases can involve Second Offender Aftercare or the Second Offender 14-Day Residential Program, and BSAS licenses all of these programs. A 24Q assessment is mandatory after certain alcohol-related convictions. Program options appear on the DUI and DWI programs page, and veterans can compare veterans rehab in Massachusetts.

Section 35 civil commitment

Under Section 35 of M.G.L. c.123, a civil route separate from any criminal charge, a court can commit a person with an alcohol or substance use disorder to inpatient treatment when that use creates a likelihood of serious harm.

Will a Massachusetts court accept any licensed treatment program?

Not necessarily. A Massachusetts license is a baseline, and the court and the supervising officer decide whether a particular program satisfies an order.

The Bureau of Substance Addiction Services (BSAS) in the Department of Public Health licenses substance use disorder treatment programs under 105 CMR 164.000. Ask the admissions team for its BSAS license details and compare them with the level of care written on the order. RehabSeekers.com cannot tell you whether a court will accept a given program.

Reporting to a Massachusetts judge or probation officer requires your written consent. Under the federal confidentiality rules for substance use disorder records, 42 CFR Part 2, a program generally needs a signed consent form before it shares attendance or progress. Ask intake staff whether they send reports, how often, and exactly what the form allows them to disclose.

What levels of care can a Massachusetts court require?

A Massachusetts order may name a level of care or a minimum length, or it may require an assessment first and leave the setting to the clinician’s recommendation.

Level of careHow it may appear in an order
DetoxOften the first step before other care. Withdrawal from alcohol, benzodiazepines or opioids can be medically serious, so it needs clinical supervision.
ResidentialLive-in treatment, sometimes with a minimum stay written into the order.
PHPDay treatment most weekdays, with nights at home.
IOPSeveral sessions a week, often alongside work or probation check-ins.
OutpatientCounseling sessions on a set schedule, common after a higher level of care.

Medication for opioid use disorder, such as methadone or buprenorphine, appears in many Massachusetts listings, and BSAS regulates opioid treatment services. Whether a particular specialty session places conditions on medication is a question for that court. Prescribers are listed on the Suboxone clinics page.

How do you pay for court-ordered treatment in Massachusetts?

Court-ordered treatment in Massachusetts is paid for the same ways as voluntary care: MassHealth, private insurance, state-funded services or a sliding fee, depending on what each program accepts.

MassHealth, the state’s Medicaid program, expanded in 2014. For PCC Plan and Primary Care ACO members, behavioral health runs through the Massachusetts Behavioral Health Partnership. Chapter 258 of the Acts of 2014 requires MassHealth and state-regulated insurers to cover acute treatment and clinical stabilization services without prior authorization. See Medicaid-accepting rehab for more.

Massachusetts residents without coverage can compare state-funded rehab and sliding scale programs. The state’s published rate for publicly purchased residential rehabilitation is $196.24 per day, not including room and board, effective July 1, 2026.

What happens if you miss sessions on a Massachusetts treatment order?

The judge decides what follows a missed session, and the response varies with the case, the court and the terms of the order.

If you miss or expect to miss a session, tell your probation officer or attorney early.
